After four days in trial in Orange County, our partner, Juan Delgado secured a trial victory! The case arose from a minor 2–3 mph sideswipe collision with minimal vehicle damage and no injuries reported at the scene. Plaintiff later alleged extensive orthopedic and spinal injuries, underwent a two-level cervical disc replacement surgery, and claimed significant medical specials, all on a lien basis. Plaintiff rejected our client’s attempts to settle and rejected all settlement offers, discharged counsel, and proceeded to trial in pro per (without a lawyer).
Through strong expert testimony and effective cross-examination, the defense focused on challenging causation as well as the nature, extent, and reasonableness of the claimed treatment, emphasizing the lack of objective evidence supporting the alleged injuries. Ultimately, the Court agreed with the defense and granted a motion for non-suit, resulting in a complete defense victory. Our client was extremely pleased with the outcome.
